“You” & “Us“

The following Terms of Use are entered into by and between You and Rachel Thompson, d/b/a Rachel Thompson Writing Courses (“Company”, “we”, or “us”).

The Service

Rachel Thompson Writing Courses offers private coaching sessions, educational courses and online resources, a private member dashboard, and a community of writers (“Service”).

Payment Policies

All purchases must be made by credit card using Stripe’s payment processing service or PayPal’s payment processing service. (Note: By making a purchase, you also agree to Stripe and PayPal’s user agreement.)

All purchases are made in USD and are inclusive of applicable taxes for Canadian residents.

In the event that your subscription payment fails, you will lose access to the Service (i.e. your course or membership) until the balance is paid in full.

Refund & Cancellation Policies

Unless specified, all purchases are non-refundable.

For this reason, before you purchase any Service, we encourage you to subscribe to our newsletter and read the testimonials on the course or membership you are considering to make sure Rachel‘s teaching style is a good fit for you and your writing.

You may cancel your monthly payment plan for the Service at any time, and you will not be charged again. As monthly payments are installments toward “lifetime” access to the Service, upon cancellation, you will immediately lose access to the Service.

We reserve the right to cancel and/or refund your purchase/subscription if you are shown to be in breach of our Community Guidelines (see below).

Unlimited “Lifetime” Access Terms

In marketing materials, when we refer to receiving “lifetime“ access to the Service, we are referring specifically to the online educational resources within the Service. This means that when you have paid in full for lifetime access to the Service, this access endures for the lifetime of the Company and not the lifetime of the human being offering the Service.

For the duration of this agreement, we shall maintain the Site to provide you access to our work.

The Service and the Site are provided as-is and without guarantees of results for your writing development. (That‘s up to you and the work you put into your writing.) We will not be responsible for any damages of any kind resulting from the use of the Site, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

As a small Company, we can’t guarantee that the Site will be up 100% of the time or that your access might not be limited due to power outages or any other forces outside our control. We will take reasonable steps to maintain the Site and correct problems as they occur.

Community Guidelines

You agree that when using features of the Site that allow for communication by you, joining our live calls on Zoom, or communicating in our Slack channels, that you will not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others. (Note: By using the Service, you also agree to the terms and conditions of use for both Slack and Zoom.)

You agree not to publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information, or upload files unless you own or control the rights thereto or have received all necessary consents.

You agree not to advertise or offer to sell or buy any goods or services for any business purpose, or harvest or otherwise collect information about others, including e-mail addresses, without their consent or violate any applicable laws or regulations.

You agree not to discuss or share any information outside of our community Slack channels and Zoom calls about writing submitted by your peers in private correspondence and group workshops without having received all necessary consents.

We reserve the right to review materials posted to Slack or on the Site and to remove any materials at our sole discretion. We reserve the right to terminate your access to any or all of the user communication services at any time without notice for any reason whatsoever and to disclose any information as necessary to satisfy any applicable laws.

Jurisdiction

This agreement between you, the user, and Rachel Thompson shall be governed by and interpreted in accordance with the laws of the province of Quebec and the laws of Canada applicable therein. You hereby consent and submit to the exclusive jurisdiction of the courts of the province of Quebec in any proceeding related to this agreement.

Updates to these terms

We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on this Site. Any use of the Site or Service by you after being notified means you accept these amendments. We will post the most recent versions to the Site and list the effective dates on the pages of our Terms and Conditions.
